Purpose: These Terms and Conditions (“Terms”) serve as a binding agreement between you and Entigy Forms & Data Solutions (“Service” or “Entigy” or "Edan Pty Ltd") and govern your use of the Service: an online forms builder software-as-a-service platform. These Terms set forth the rules, rights and responsibilities of both parties and it is important that you carefully read and understand them before using the Service.
Data Storage and Security: All data generated and stored through the use of the Service will be stored on servers located in Australia. Entigy takes reasonable measures to ensure the security of the data stored on its servers, however, Entigy cannot guarantee the security of your data and it is your responsibility to maintain the confidentiality of your account information and password.
Data Ownership: It is important to note that any data generated through the use of the Service belongs solely to you. Entigy will not access, use or disclose such data except as necessary to provide the Service or as required by law.
Account Termination: Entigy reserves the right to terminate your account at any time, with or without notice, for any reason, including, but not limited to, violation of these Terms, requests by law enforcement, or requests by you. Upon termination, all data stored by the Service will be deleted and will not be recoverable.
Changes to Terms and Service: Entigy reserves the right to modify these Terms at any time, without notice to you. If changes are made, Entigy will update the date at the top of this page and may provide additional notice to you by other means. Your continued use of the Service after any changes to these Terms constitutes your acceptance of the new Terms.
Disclaimer of Warranties: The Service is provided on an “as is” and “as available” basis. Entigy makes no representations or warranties of any kind, express or implied, as to the operation of the Service or the information, content, materials, or products included on the Service.
Limitation of Liability: Under no circumstances will Entigy be liable for any damages, including, but not limited to, direct, indirect, special, incidental, or consequential damages, losses or expenses arising in connection with the Service, its use, or inability to use by any party, or in connection with any failure of performance, error, omission, interruption, defect, delay in operation or transmission, computer virus or line or system failure, even if Entigy, or its representatives, are advised of the possibility of such damages, losses or expenses.
Governing Law: These Terms and the use of the Service will be governed under the laws of Australia.

Entire Agreement: These Terms constitute the entire agreement between you and Entigy and supersede all prior agreements and understandings, whether written or oral, relating to the Service.
